Our Responsibilities
SDBody is required by law to maintain the privacy and security of your protected health information (“PHI”) and to give you this notice of our legal duties and privacy practices. We will:
- Follow the duties and privacy practices described in the notice currently in effect, and give you a copy of it.
- Notify you if a breach occurs that may have compromised the privacy or security of your information.
- Not use or share your information other than as described here unless you give us written permission. You may revoke that permission in writing at any time, except to the extent we have already acted on it.
How We Use and Share Your Information

Business associates. We may share your information with companies that perform services for us, such as our electronic health record, billing, and lab vendors. They must sign an agreement to protect your information.

Your Choices
For certain information, you can tell us your choices about what we share. You have both the right and the choice to tell us to:
- Share information with your family, close friends, or others involved in your care or payment for your care.
- Share information in a disaster relief situation.
If you are not able to tell us your preference, for example if you are unconscious, we may share your information if we believe it is in your best interest. We may also share information when needed to lessen a serious and imminent threat to health or safety.
Text messages and email. If you ask us to contact you by unencrypted email or text, we will, but there is some risk that the message could be read by someone else. You can tell us at any time to stop.
Uses That Require Your Written Permission
We will never share your information for the following without your written authorization:
- Marketing purposes (as defined by law)
- Sale of your information
- Most sharing of psychotherapy notes
We do not use your information for fundraising.
Your Rights
See or get a copy of your medical record. You can ask to see or get an electronic or paper copy of your medical record and other health information we have about you. Ask us in writing. Under California law, we will let you inspect your record within 5 working days of your request and provide copies within 15 days. We may charge a reasonable, cost-based fee for copies.
Ask us to correct your record. You can ask us in writing to correct health information you think is incorrect or incomplete. We may say no, but we will tell you why in writing within 60 days. Under California law, you may also add a written statement of up to 250 words to your record about any item you believe is incorrect or incomplete.
Request confidential communications. You can ask us to contact you in a specific way (for example, by cell phone instead of home phone) or to send mail to a different address. We will say yes to all reasonable requests.
Ask us to limit what we use or share. You can ask us not to use or share certain information for treatment, payment, or operations. We are not required to agree, and we may say no if it would affect your care. If you pay for a service or health care item in full out of pocket, you can ask us not to share that information with your health insurer for payment or operations. We will say yes unless a law requires us to share it.
Get a list of those we’ve shared information with. You can ask for a list (accounting) of the times we’ve shared your information for up to six years before the date you ask, who we shared it with, and why. This list will not include disclosures for treatment, payment, and operations, and certain other disclosures. We provide one list a year for free and may charge a reasonable, cost-based fee for additional lists within 12 months.
Get a copy of this notice. You can ask for a paper copy of this notice at any time, even if you agreed to receive it electronically.
Choose someone to act for you. If you have given someone medical power of attorney or someone is your legal guardian, that person can exercise your rights and make choices about your health information. We will confirm that person has this authority before we take any action.
File a complaint. If you believe your privacy rights have been violated, you can file a complaint with our Privacy Officer using the contact information below. You can also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights at 200 Independence Avenue, S.W., Washington, D.C. 20201, by calling 1-877-696-6775, or online at www.hhs.gov/ocr/complaints. We will not retaliate against you for filing a complaint.
California Patients
California law, including the Confidentiality of Medical Information Act (CMIA), gives you more protection than federal law in some cases. When California law is stricter, we follow California law. For example:
- We will not share your medical information with your employer, or use it for purposes other than those described in this notice, without your written authorization, unless the law allows it.
- HIV test results, mental health records, substance use disorder records, and certain sensitive services you consent to as a minor receive extra protection and generally require your specific written authorization before we share them.
- We do not share information about sensitive services, such as reproductive or gender-affirming care, in ways prohibited by California law.
Changes to This Notice
We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, posted in our offices, and posted on our website.
